Terms of Service

Section 1. Research Use Only

All products offered by Honest Peptide, including but not limited to peptides, proteins, research chemicals, reagents, and related substances (“Products”), are sold for in vitro laboratory research purposes only. Products are not intended for human or animal consumption or use in food, drugs, devices, or cosmetics. Buyer acknowledges that Products are experimental and have not been evaluated by the U.S. Food and Drug Administration or any other regulatory authority.

Section 2. Buyer Eligibility

Buyer affirms that they are at least twenty-one (21) years of age and have the knowledge, training, and authorization necessary to lawfully acquire and use the Products for laboratory research purposes. Buyer is solely responsible for ensuring compliance with institutional or organizational requirements.

Section 3. Regulatory Compliance

Buyer represents and warrants that they will comply with all applicable laws, regulations, and directives relating to the acquisition, handling, storage, use, and disposal of the Products, including but not limited to local, state, federal, and international requirements. Buyer is solely responsible for obtaining any required permits or licenses.

Section 4. Restrictions on Use and Transfer

Buyer agrees that Products shall be used only for in vitro laboratory research purposes and shall not be:
(a) used or permitted to be used in or on humans or animals;
(b) used for diagnostic, therapeutic, clinical, or household purposes;
(c) repackaged, relabeled, resold, exported, or otherwise transferred to any third party without prior written consent from Honest Peptide; or
(d) introduced into interstate or international commerce for purposes not authorized herein.

Section 5. Intellectual Property

All content, materials, trademarks, and proprietary information on the Site are the property of Honest Peptide or its licensors and are protected under applicable law. Purchase of a Product does not grant any license under existing intellectual property or patent rights. Buyer bears sole responsibility for determining patent clearance.

Section 6. Orders, Pricing, and Payment

Prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to reject or cancel any order, in whole or in part, at our discretion. Payment is due at checkout. Buyer agrees not to reverse or dispute charges without first attempting to resolve the issue with Honest Peptide in good faith.

Section 7. Shipping, Title, and Risk of Loss

Title and risk of loss pass to Buyer upon delivery of Products to the shipping carrier. Honest Peptide is not responsible for delays, damage, or loss once Products are in transit. Buyer is responsible for customs clearance, duties, and compliance with import/export regulations.

Section 8. Returns

Returns are accepted only in accordance with our published Returns & Refunds Policy, as amended from time to time.

Section 9. Indemnification

Buyer agrees to indemnify, defend, and hold harmless Honest Peptide, its officers, employees, agents, successors, and assigns from and against any and all claims, damages, liabilities, losses, costs, and expenses (including but not limited to attorneys’ fees) arising out of or relating to Buyer’s use or misuse of the Products, breach of this Agreement, or violation of applicable law.

Section 10. No Warranties

THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” HONEST PEPTIDE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, CREATES ANY WARRANTY NOT EXPRESSLY STATED HEREIN.

Section 11. Limitation of Liability

IN NO EVENT SHALL HONEST PEPTIDE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, BUSINESS INTERRUPTION, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO THE PRODUCTS OR THIS AGREEMENT. HONEST PEPTIDE’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY BUYER FOR THE SPECIFIC PRODUCT(S) AT ISSUE.

Section 12. Confidentiality

Any non-public information provided by Honest Peptide, including but not limited to proprietary protocols, pricing, and product specifications, shall be treated as confidential and not disclosed without prior written consent.

Section 13. Modifications

We may update or modify this Agreement at any time by posting changes on the Site. Continued use of the Site or purchase of Products after posting constitutes acceptance of the modified Agreement.

Section 14. Governing Law and Venue

This Agreement shall be governed by the laws of the State of New York, without regard to conflict of law principles.

Section 15. Arbitration and Class-Action Waiver

Any dispute, claim, or controversy arising out of or relating to this Agreement or the Products shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in New York, New York. The parties agree that arbitration shall be conducted in their individual capacities only and not as a class, collective, or representative proceeding, and expressly waive any right to bring or participate in such proceedings. Nothing herein prevents either party from seeking relief in small claims court where jurisdictional requirements are satisfied.

Section 16. Entire Agreement and Severability

This Agreement, together with any referenced policies, constitutes the entire agreement between Buyer and Honest Peptide. If any provision is found invalid or unenforceable, it shall be limited or eliminated to the minimum extent necessary, and the remainder shall remain in full force and effect.

By accessing the Site or placing an order, Buyer acknowledges and affirms that they have read, understood, and agreed to be legally bound by this Terms of Service Agreement.
